Activities and service scope

HB Advisory offers: (a) professional development courses in Regulatory Affairs for pesticides and related products, available online (recorded), online (live) and in-person in-company; (b) regulatory management SaaS systems for agribusiness companies; (c) regulatory consulting. All services are delivered via internet or in-person as contracted.

1. Privacy Policy & LGPD

1.1 Data controller

1.2 Data collected

We collect: (a) data voluntarily provided in forms — name, email, company, job title, phone; (b) browsing data — IP address, device type, pages visited, session duration; (c) transaction data — for course purchases: full name, CPF/CNPJ (Brazilian tax IDs), billing address, payment data processed by third parties (Stripe). We do not store credit card data — that processing is handled exclusively by contracted payment platforms.

1.3 Legal basis (LGPD — Law 13,709/2018)

Data processing is based on: (a) contract performance — to deliver purchased courses and services; (b) legitimate interest — for communications about educational and regulatory content, site performance analysis; (c) consent — for newsletters, which you may revoke at any time. Consent can be withdrawn via contato@hb-advisory.com.br or through the unsubscribe link in emails.

1.4 Use of data

We use your data to: deliver purchased courses and materials; send communications related to contracted services; send newsletters and educational content (with consent); personalise your platform experience; comply with legal and tax obligations; ensure security and fraud prevention.

1.5 Sharing

We do not sell personal data. We share data only with contracted service providers under confidentiality agreements: Supabase (data storage), Mailgun (transactional email), Google Workspace (communications), Stripe (payment processing), Vercel (website hosting). All providers are subject to their own privacy policies. For international buyers, Stripe may process data on servers outside Brazil, with standard contractual clauses for international data transfer as required by the LGPD.

1.6 Data retention

Customer data with completed purchases is retained for the minimum period required by Brazilian tax law (5 years). Lead and non-customer data is deleted after 2 years of inactivity or upon request. Platform access data is retained while the account is active and for up to 1 year after closure.

1.7 Your rights (LGPD, Art. 18)

You have the right to: confirm the existence of processing; access your data; correct incomplete or inaccurate data; anonymisation, blocking or deletion of unnecessary data; portability; information about sharing; revocation of consent; objection to processing. To exercise any right, send a request to contato@hb-advisory.com.br. We will respond within 15 business days.

1.8 International transfers

Service providers (Supabase, Mailgun, Stripe, Vercel) may process data on servers outside Brazil. All adopt adequate security measures and are subject to standard contractual clauses for international data transfer under the LGPD and, where applicable, the GDPR (for buyers in the European Union and United Kingdom).

2. Terms of Use

2.1 Acceptance

Accessing and using this site and HB Advisory platforms implies full acceptance of these terms. If you do not agree, do not use the services.

2.2 Intellectual property

All content on this site — texts, images, videos, course materials, handouts, presentations and methodologies — is the property of Hudson Viana Borges (HB Advisory) or licensed from third parties. Reproduction, distribution, modification or commercial use without prior written authorisation is prohibited. Personal, non-commercial use is permitted with source attribution.

2.3 User conduct

The following are prohibited: using the platforms for unlawful purposes; attempting to access restricted areas without authorisation; reproducing or redistributing course materials to third parties; sharing access credentials; reverse engineering any system; using unauthorised bots, scrapers or automations.

2.4 Educational content

Course materials are for educational purposes only. They do not constitute legal, regulatory or technical advice for specific cases. HB Advisory is not responsible for decisions made based solely on course materials without proper analysis of each company's or situation's specific context.

2.5 Limitation of liability

HB Advisory is not liable for: indirect, incidental or consequential damages arising from use or inability to use the services; temporary service interruptions due to maintenance or technical failures; user decisions based on information from the site. In no event shall HB Advisory's total liability exceed the amount paid by the user in the preceding 12 months.

2.6 Modifications

HB Advisory reserves the right to modify these terms at any time. Material changes will be communicated by email to registered users at least 15 days in advance. Continued use after modifications implies acceptance of the new terms.

2.7 Governing law and jurisdiction

These terms are governed by Brazilian law. The courts of São Paulo, SP are elected for dispute resolution, without prejudice to other alternative dispute resolution mechanisms. For buyers in the European Union, locally applicable mandatory consumer protection rules also apply.

3. Cancellation and Refund Policy

3.1 Buyers in Brazil — Right of withdrawal (CDC, Art. 49)

For purchases made online by consumers in Brazil, the withdrawal period is 7 (seven) calendar days from the date of purchase, without need for justification, under the Consumer Protection Code (Law 8,078/1990, Art. 49). To exercise this right, access the student area and use the cancellation form, or send a request to contato@hb-advisory.com.br. Cancellation is processed automatically — no manual approval is required within the legal withdrawal period.

3.2 Buyers in the European Union and United Kingdom

Consumers resident in the European Union have a right of withdrawal of 14 (fourteen) calendar days from the date of purchase, under Directive 2011/83/EU. Consumers in the United Kingdom have the same period under the Consumer Contracts Regulations 2013. For digital content whose execution begins immediately after purchase, the right of withdrawal may be expressly waived at the time of purchase; however, HB Advisory will apply the 14-day period as an additional guarantee regardless of any waiver. Refund processed within 14 days after cancellation approval.

3.3 Buyers in the US and other countries

For buyers outside Brazil, EU and the UK, HB Advisory applies the following voluntary policy: full refund requested within 7 (seven) calendar days of purchase, without content access; 50% partial refund requested between 7 and 14 days, provided the content has not been more than 20% accessed. After 14 days or with substantial content access, no refund is available, except under the exceptions in section 3.4. Contracts are governed by Brazilian law; disputes will be resolved in the courts of São Paulo, Brazil.

3.4 Exceptions after the withdrawal period

Full refund outside the regular period is granted only in cases of: (a) documented technical defect preventing access to purchased content; (b) cancellation of the course or cohort by HB Advisory before delivery; (c) duly documented force majeure.

3.5 Online Live and In-Company

For scheduled cohorts (online live) and in-person in-company training: cancellation more than 7 days in advance — full refund or rescheduling at no cost. Cancellation between 3 and 7 days — 50% refund or free slot transfer. Cancellation less than 3 days in advance — no refund; slot transfer subject to availability. For in-company training with a signed contract, specific contractual conditions prevail; in the absence of a clause, the above periods apply with an additional penalty for travel costs already incurred.

3.6 How to cancel

Cancellation can be requested: (a) directly in the student area, via the cancellation form — automatic processing within 2 business days; (b) by email to contato@hb-advisory.com.br, with full name, CPF/CNPJ and order number — response within 2 business days. The refund is credited via the same payment method used at purchase within 10 business days of confirmation, subject to the card operator's processing time (usually 1 to 2 billing cycles).

4. Cookie Policy

4.1 What are cookies

Cookies are small text files stored on your device when you visit a website. They allow the site to recognise your device on subsequent visits and improve your browsing experience.

4.2 Strictly necessary cookies

These cookies are essential for the site to function and cannot be disabled: session authentication (hb_ai_session) — enables access to the student area and authenticated platforms; language preferences — retains the selected language between sessions. These cookies do not collect personally identifiable information and are not used for marketing purposes.

4.3 Analytical cookies (optional)

Google Analytics 4 (ID: G-2MN3GKC97W) — anonymous and aggregated traffic and browsing behaviour analysis. Data is used solely for site improvement. You may opt out by installing the add-on available at tools.google.com/dlpage/gaoptout, or by declining these cookies in the consent banner.

4.4 Marketing cookies (optional)

Google Ads (AW-18057733486), Meta Pixel (1377092244453001) and LinkedIn Insight Tag (9843817) — used for campaign conversion measurement and display of relevant advertisements on partner platforms. These cookies are activated only upon your explicit consent. You may withdraw consent at any time in the site's cookie settings.

4.5 Control and retention

You can manage cookie preferences at any time: (a) via the consent panel on this site; (b) in your browser settings. Session cookies: expire when you close the browser. Persistent cookies: expire between 30 days (preferences) and 2 years (analytics and marketing). Disabling non-essential cookies does not affect access to site content.

5. Course Purchase Conditions

5.1 Nature of the course

HB Advisory courses are non-regulated professional development courses under Law 9,394/1996 (LDB), Art. 39. They are not MEC-regulated courses and do not confer undergraduate, postgraduate, technical specialisation or regulated professional qualification degrees. The certificate issued is a completion/participation certificate for a free professional development course; its recognition by professional councils, examinations, universities or continuing education programmes depends exclusively on the regulations of each institution or body receiving it.

5.2 Modalities and contracting

Courses are offered in the following modalities: (a) Recorded online — individual platform access, available immediately after payment confirmation; (b) Live online — cohorts scheduled by video conference, access released upon enrolment confirmation, minimum cohort size of 10 participants; (c) In-person in-company — held at the client's premises, subject to a specific commercial proposal and contract. For modalities (b) and (c), contracting is formalised via proposal and agreement between the parties.

5.3 Pricing and payment conditions

Prices are displayed on the sales platform at the time of purchase, in Brazilian reals (BRL), inclusive of applicable taxes. Accepted payment methods: credit card, bank slip (boleto) and PIX. For corporate contracts, conditions are negotiated via commercial proposal. Prices may change without prior notice, but a completed purchase guarantees access at the price paid.

5.4 Access period and conditions

Recorded online modules are available for 12 (twelve) months from the date access is granted. Access credentials are personal and non-transferable. Sharing access is prohibited and may result in account cancellation without refund. Content updates are made at HB Advisory's discretion and communicated when available, with no guarantee of timing or frequency.

5.5 Cancellation and refund

The rules of Section 3 (Cancellation and Refund Policy) apply in full. Cancellation can be requested directly in the student area, without needing to send an email within the legal withdrawal period.

5.6 Completion certificate

Recorded online modules: certificate issued automatically after 100% of the content is completed on the platform, with workload and completion date. Live and in-company modules: certificate issued upon a minimum attendance of 75% of the total workload. The certificate identifies the course as a free professional development course, is not equivalent to an official qualification and does not authorise the practice of regulated professions.

5.7 Technical support and content queries

Platform access issues: contato@hb-advisory.com.br, response within 1 business day. Course content queries: answered by the instructor by email, within 3 business days. Support available on business days, 9 am – 6 pm (Brasília time).

5.8 Invoices

Service invoices (notas fiscais) are automatically issued for legal entities (CNPJ) and sent by email within 5 business days after payment confirmation. Individuals receive a payment receipt. For specific invoice requests, contact contato@hb-advisory.com.br.

6. Support and Service Level (SLA)

6.1 Scope of included support

Standard support includes: (a) technical support for access and operation of the course platform and contracted SaaS systems; (b) clarification of queries about documented features; (c) reporting of errors and instabilities. Not included in standard support: implementation, personalised initial configuration, third-party system integrations, additional operational training, customisations of any kind and regulatory consulting — these items are charged separately upon proposal.

6.2 Channels and service hours

Primary channel: contato@hb-advisory.com.br. WhatsApp +55 11 99715-9260 (commercial service, does not replace formal ticket opening). Hours: business days, 9 am – 6 pm (Brasília time). Outside these hours, requests are logged and handled on the next business day.

6.3 Response times

Critical incidents (platform unavailable or error preventing access to paid content): response within 4 business hours, resolution within 1 business day. Functional errors (specific feature with incorrect behaviour): response within 1 business day, resolution within 5 business days. Queries and information requests: response within 2 business days. The above times are reasonable effort targets and do not constitute a contractual guarantee unless specified in a corporate contract.

6.4 System availability

HB Advisory makes reasonable efforts to maintain a minimum monthly availability of 99% for SaaS systems. The following are not counted as downtime: scheduled maintenance windows (communicated 48 hours in advance), failures in third-party services (Supabase, Vercel, Stripe), telecommunications or power outages beyond HB Advisory's control.

6.5 Bug, improvement and customisation — distinction

Bug: system behaviour deviating from published documentation — treated as an incident and corrected at no cost. Improvement: new feature or change to existing behaviour — included in the product roadmap, without guaranteed timeline, at no additional cost. Customisation: development specific to a client's need — subject to proposal and charged separately. Classification is HB Advisory's responsibility; disagreements may be discussed by email.

6.6 Service suspension and termination

Access to the system may be suspended in cases of: non-payment after 15 days from the due date; documented misuse (unauthorised sharing, reverse engineering, unlawful use). Permanent termination with loss of access occurs after 30 days of unresolved non-payment or for serious breach of the Terms of Use. In the event of termination by HB Advisory without fault attributable to the client, a 30-day period for data export will be guaranteed.

7. Accessibility

7.1 Commitment

HB Advisory is committed to digital accessibility in compliance with the Brazilian Law of Inclusion (Law 13,146/2015, Art. 63) and the W3C WCAG 2.1 Level AA guidelines. Our goal is to ensure that the site, the course platform and educational materials are accessible to as many people as possible, regardless of physical, sensory or cognitive limitations.

7.2 Implemented features

Currently implemented: colour contrast meeting WCAG 2.1 AA standard; keyboard navigation on main pages; descriptive labels in forms; alternative text for informative images; structured HTML semantics; text resizing without loss of functionality. We are in an ongoing review process to extend coverage to the video player, PDFs, student area and checkout.

7.3 Known limitations

Not yet fully accessible: captions and transcripts for all course videos (being progressively implemented); PDFs with complete semantic markup; video player with keyboard controls. We are working to address these limitations.
